Acceptable Use Policy

This Acceptable Use Policy ("AUP") applies to everyone who uses the Xelp platform, operated by Blaze Technologies Inc. It exists to protect message recipients, our customers, Xelp, and the channel platforms we integrate with. It supplements Section 4 of the Terms of Service; violations can lead to suspension or termination as described there.

1. Respect channel policies — especially WhatsApp's

When you use WhatsApp through Xelp you must comply with Meta's WhatsApp Business Terms of Service, WhatsApp Business Messaging Policy and WhatsApp Commerce Policy, including:

  • Sending only message categories and template types permitted by Meta.
  • Selling only goods and services allowed by the Commerce Policy.
  • Honoring WhatsApp's quality signals — repeated blocks and reports can degrade or disable your number, and we may intervene first.

Equivalent platform policies and applicable telecommunications and anti-spam regulations apply to Instagram, Facebook Messenger, Telegram, TikTok, SMS, and email use (Terms, Section 3).

2. Opt-in is mandatory

You may only send outbound (business-initiated) messages to people who gave prior, verifiable consent to receive that category of message from you, and you must honor opt-outs promptly (Terms, Section 4.2). Purchased lists, scraped numbers, and "implied" consent are prohibited. Keep records of opt-ins; we may request evidence.

3. No spam

Do not send unsolicited bulk messages, exceed reasonable frequency for the consent you hold, or disguise promotional content as transactional. Xelp automatically honors STOP / UNSUBSCRIBE keywords and suppresses opted-out contacts from broadcasts — circumventing this suppression is a material breach.

4. Prohibited content and conduct

Consistent with Section 4.3 of the Terms, you must not use the Service to:

  • send spam or messages to individuals who have not opted in;
  • engage in unlawful, deceptive, fraudulent, harassing, or abusive conduct;
  • sell or promote goods or services prohibited by law or by the policies of connected platforms;
  • upload or transmit malware, or probe, breach, or circumvent security measures;
  • infringe intellectual property, privacy, or other rights of any person;
  • impersonate others or misrepresent who is messaging;
  • resell, sublicense, or provide the Service to third parties except as expressly permitted;
  • reverse engineer or copy the Service, or use it to build a competing product;
  • exceed usage limits, circumvent metering, or interfere with the Service;
  • submit sensitive personal data (e.g. health, biometric, or government ID data) except as expressly agreed in writing (Terms 4.3; DPA 3.2).

5. Commerce

If you use the Commerce Module, you are the seller of record: you are responsible for your products, pricing, taxes, fulfilment, returns, and compliance with e-commerce and consumer protection laws (Terms, Section 5).

6. AI usage

AI-assisted responses you enable must be disclosed to End Users where applicable law requires disclosure of automated communications, and you are responsible for reviewing AI-assisted content before relying on it (Terms, Section 1.3). AI features must not be configured to generate prohibited content.

7. Enforcement

We may suspend or restrict accounts that violate this AUP — immediately where the violation poses a security risk, breaks the law or platform policies, or is required by a platform or legal authority; where practicable, we will provide notice and an opportunity to cure (Terms, Section 4.4). Where legally required, we will report unlawful activity.
